Micronesia capital gains tax: none for individuals

The Federated States of Micronesia has no personal capital gains tax, so the tax on your investment gain is zero. National law taxes individuals on wages and salaries at 6% on the first $11,000 and 10% above, and businesses on gross revenues at 3% above $10,000. A private sale of shares, crypto or property is neither, because the definition of a business excludes casual sales.

Verified as of 2026-09-30 against Title 54 of the FSM Code.

Questions

Micronesia capital gains tax questions

Does Micronesia have a capital gains tax?

No. The national tax on individuals is the wage and salary tax under 54 FSMC 121, which charges 6% on the first $11,000 and 10% above that, and it applies to compensation for personal services performed as an employee. A gain on shares, funds, crypto or property is not compensation, so it is not taxed, at any holding period or size of gain.

Does the gross revenue tax apply to my sale?

Not to a private sale. The gross revenue tax under 54 FSMC 141 falls on businesses, and the statute's definition of a business excludes casual sales. Selling your own shares, crypto or a property you held as an investment is a casual sale, not a business receipt. A person who trades as a business pays the tax on gross receipts.

Is crypto taxed in Micronesia?

Not as a capital gain. A private disposal of crypto is treated like shares or property, at zero. There is no VAT or GST either: Title 54 levies the wage and salary tax, the gross revenue tax, corporate income tax and import duties, and nothing on value added.

Who is the tax authority?

The Customs and Tax Administration Division of the FSM Department of Finance and Administration. It registers taxpayers, processes returns and payments and administers the national taxes, including the corporate income tax that applies to corporations and not to an individual's personal disposal.

What does the FSM Code tax individuals on?

The Federated States of Micronesia imposes no capital gains tax on individuals: the national tax on individuals is the wage and salary tax under 54 FSMC 121, six percent on the first $11,000 and ten percent on the amount over $11,000 of wages and salaries received by an employee, and wages and salaries are defined as compensation for personal services performed as an employee, so the gain on selling shares, crypto or property is not within it. What is the gross revenue tax?

The only other national tax on earnings is the gross revenue tax under 54 FSMC 141, $80 a year on the first $10,000 of gross revenues and three percent of gross revenues above $10,000, charged on every business; 54 FSMC 112 defines a business as an undertaking carried on for pecuniary profit and excludes casual sales, so a private sale of an investment is not a business receipt. What about corporations?

Corporations pay a separate corporate income tax administered by the Customs and Tax Administration Division of the Department of Finance and Administration; it applies to corporations and not to an individual's gain on a personal disposal. Do import duties apply to a sale?

Import duties under 54 FSMC 221 are levied at the border on listed goods such as tobacco, cosmetics, soft drinks, beer and spirits, on the CIF price of the goods; they are not charged on a sale of shares, crypto or property. Source: https://fsmlaw.org/fsm/code/title54/T54_Ch02.htm
