Legal
Terms of use
Last updated 12 October 2026
These terms apply to capitalgainstax.net (the site) and the CapitalGainsTax.net plugin for ChatGPT (the plugin), together the Service, operated by Native App Lab (we, us, our). By using the Service you agree to these terms. If you do not agree, do not use the Service.
General information, not advice
The Service provides general information about capital gains tax and calculators that apply published tax rules to the figures you enter. It does not provide tax, financial, legal or accounting advice, and it does not take your personal circumstances into account beyond the figures and settings you enter.
The Service is not a tax agent service, and using it does not create an adviser-client or any other professional relationship between you and us. Before you file a return, make a payment, or buy, sell or hold an asset, confirm your position with your tax authority or a registered tax agent or qualified adviser in your country.
Accuracy of rates and calculations
We build the rates, thresholds and rules from official sources and record the date each was read. Tax law changes, sources are revised, and a calculator models the rules it describes, which may not cover every exemption, election, relief, treaty or situation that applies to you. Results depend entirely on the figures and settings you provide.
To the extent permitted by law, we do not warrant that any information, rate or result is accurate, complete, current or suitable for your purposes. You are responsible for checking the figures you rely on and for the returns you file and the tax you pay.
The ChatGPT plugin
The plugin is provided through OpenAI's ChatGPT, and OpenAI's own terms and policies also apply to your use of ChatGPT. Our responsibility covers the results our server returns to ChatGPT. ChatGPT writes its own replies, which may summarise, rephrase or misstate those results or add information of its own; we are not responsible for what ChatGPT writes. The calculator link the plugin provides opens the site, where these terms continue to apply.
Using the Service
You may use the Service for your own personal or internal business purposes. You must not:
- Use the Service in breach of any law or to help anyone else do so.
- Copy, scrape, republish or resell the Service's rates, tables, calculators or content in bulk, or use them to build a competing product, without our written permission.
- Send automated requests to the site or the plugin's server at a volume that burdens them, or attempt to bypass any limit we set.
- Interfere with, probe or disrupt the Service or its security, or introduce malicious code.
- Misrepresent your relationship with us or present the Service's results as advice given by us.
Intellectual property
The Service, including its text, tables, calculators, code, design and branding, is owned by or licensed to Native App Lab and protected by copyright and other laws. Tax legislation and official publications quoted on the site belong to their authors. You may share links to the Service and quote short extracts with a link back to the source page.
Third-party links and sponsored placements
The Service links to tax authorities and other third-party websites and may carry sponsored placements from tax professionals and other businesses. We do not control those websites or businesses, and a link or sponsored placement is not an endorsement or recommendation. Any service you obtain from a sponsor or third party is between you and that party, on its terms.
Changes and availability
We may change, suspend or discontinue any part of the Service at any time without notice, including adding, changing or removing countries, calculators, rates and features. We do not guarantee that the Service will be available at any particular time or free of errors.
Australian Consumer Law and your statutory rights
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, it is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
Disclaimer of warranties
Subject to the section above, the Service is provided free of charge on an as is and as available basis, and to the maximum extent permitted by law we exclude all warranties, conditions and representations, express or implied, including as to accuracy, completeness, fitness for a particular purpose, merchantability and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Native App Lab and its owners, contractors and suppliers are not liable to you, in contract, tort (including negligence), under statute or otherwise, for any loss or damage arising out of or in connection with the Service or your reliance on it, including any tax, duty, penalty, interest or charge you pay or are assessed, any amount you underpay or overpay, any investment or financial decision, any loss of profit, revenue, savings, data or opportunity, and any indirect, incidental, special or consequential loss.
To the maximum extent permitted by law, our total liability to you for all claims arising out of or in connection with the Service is limited to AUD 100.
Indemnity
To the extent permitted by law, you indemnify Native App Lab against any claim, loss, liability or cost (including reasonable legal costs) that a third party brings or that we incur because of your breach of these terms or your misuse of the Service.
Privacy
Our privacy policy explains how we handle information when you use the Service and forms part of these terms.
Governing law
These terms are governed by the laws in force in Australia. You and we submit to the exclusive jurisdiction of the courts of Australia, except that nothing in this clause takes away any right you have under the law of the country you live in to bring a claim in its courts.
Changes to these terms
We may update these terms at any time by publishing a new version on this page. The date at the top shows when they last changed. If you keep using the Service after a change, you accept the updated terms.
General
If any part of these terms is invalid or unenforceable, it is read down to the extent needed to make it enforceable, or severed, and the rest continues in force. If we do not enforce a right, that is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between you and us about the Service.
