Macao capital gains tax: none, stamp duty on property
Macao has no capital gains tax, so the tax on your investment gain is zero. Macao's tax statutes charge working income, business profits, property rents and the transactions on the stamp duty list; a private capital gain sits outside every one of those charges, and PwC's tax summaries mark the Macau SAR individual capital-gains rate not applicable. What a disposal of Macao real property attracts instead is asset transfer stamp duty on the property's value, paid by the buyer, and since 20 April 2024 nothing else: the resale and second-home surcharges are abolished.

The duties that do exist on a property transfer
| Charge | Detail |
|---|---|
| Asset transfer stamp duty, by band | A disposal of Macao real property pays no tax on the gain; the buyer pays asset transfer stamp duty on the value instead. A paid transfer is charged at 1% on the first 2,000,000 patacas, 2% from 2,000,000 to 4,000,000 patacas and 3% above 4,000,000 patacas, an unpaid (gratuitous) transfer at 5%, and “the tax amount is subject to an extra five percent stamp duty” on top, giving effective rates of 1.05% to 3.15% on a paid transfer (Macao Yearbook; PwC). DSF's own conveyance calculator, published on dsf.gov.mo, computes the duty from the purchase price and the property record value. The duty is owed whether the sale makes a gain or a loss: it is a transaction tax on the value, not a gains tax. |
| First-home relief | First-home relief for 2026: DSF publishes “Application for the Confirmation of Exemption of Stamp Duty for Property Conveyance (According to Article 12 of Law No. 13/2025, Government Budget of Financial Year 2026)”, so the first-time-buyer exemption continues under the 2026 Budget; the exemption was capped at three million patacas in every year 2021 to 2025 (Macao Yearbook series). |
| The abolished anti-speculation duties | Only the asset transfer stamp duty remains on property: the Macao Yearbook 2026 lists the taxes levied in Macao as “gaming tax, business tax, corporate income tax, personal income tax, real estate tax, tourism tax, excise duty, motor vehicle tax and asset transfer stamp duty” - the special stamp duty and the acquisition duties are gone from the list after their abolition by Law 5/2024 with effect from 20 April 2024. |
Questions
Macao capital gains tax questions
Does Macao have a capital gains tax?
No. The taxes levied in Macao are the gaming tax, business tax, corporate income tax, personal income tax, real estate tax, tourism tax, excise duty, motor vehicle tax and the asset transfer stamp duty; the Macao Yearbook's list is complete and no tax on a capital gain appears in it. PwC's tax summaries mark the Macau SAR individual capital-gains rate not applicable. Whether you sell shares after a week or a flat after twenty years, the gain itself is taxed nowhere.
So what does selling Macao property cost?
No tax on your gain. The charge is the buyer's: asset transfer stamp duty on the property's value, at the bands in the table below, with an extra 5% on the duty itself; owed whether the sale makes a gain or a loss. Budget laws have exempted eligible first-time buyers of a home every year since 2021, on the conditions in the relief row below. The special stamp duty on a resale within two years of purchase, the extra charge on residential purchases by companies, sole traders and non-residents, and the second-home surcharges were all abolished on 20 April 2024.
Is crypto taxed in Macao?
Not as a capital gain. Crypto is a capital asset like any other for a private, non-business sale, and there is no capital gains tax for any crypto rule to sit in. Of the taxes that do exist in Macao, namely profit tax on business income, personal income tax on working income, real estate tax on rents, the property transfer duty and the excise, tourism and motor vehicle duties, none taxes an investor's net capital gain.
When would tax touch my sale?
When you are dealing as a business. The Regulations on Profit Tax charge natural persons as well as companies on local industrial or commercial income, so habitual buying and selling for profit is taxed at the profit-tax scale, 12% on taxable profits above 300,000 patacas under the statutory table, with the annual budgets exempting the first slice of profits outright. That is profit tax on trading profits, not a tax on capital gains, and it applies whatever asset you deal in.
Why is there no capital gains tax in Macao?
Macao levies no capital gains tax on a private disposal. The Government Information Bureau's Macao Yearbook lists the taxes levied in Macao exhaustively - “Taxes levied in Macao include gaming tax, business tax, corporate income tax, personal income tax, real estate tax, tourism tax, excise duty, motor vehicle tax and asset transfer stamp duty” - and no tax on a capital gain appears in the list or in the regulations it names; PwC's Worldwide Tax Summaries mark the Macau SAR individual capital gains rate “NA” (not applicable), while corporate capital gains “are subject to the normal complementary tax rate”. A private, non-business gain on shares, funds, crypto, property or valuables is taxed nowhere, at any holding period or size of gain. Can a disposal ever be taxed as income?
The boundary is trading: the Regulations on Profit Tax charge “the total income of natural persons or legal persons ... from local industrial or commercial activities, irrespective of their place of residence or head office”, so habitual dealing in shares, crypto or property is charged as profit-tax income at the statutory scale held in the mo-income-tax records (3% to 12%, 12% above 300,000 patacas, with the annual budget exemptions noted there), not as capital gains. How is the asset transfer stamp duty calculated?
A disposal of Macao real property pays no tax on the gain; the buyer pays asset transfer stamp duty on the value instead. Is there first-home relief on the stamp duty?
First-home relief for 2026: DSF publishes “Application for the Confirmation of Exemption of Stamp Duty for Property Conveyance (According to Article 12 of Law No. 13/2025, Government Budget of Financial Year 2026)”, so the first-time-buyer exemption continues under the 2026 Budget; the exemption was capped at three million patacas in every year 2021 to 2025 (Macao Yearbook series). What happened to the special stamp duty and the second-home surcharges?
Only the asset transfer stamp duty remains on property: the Macao Yearbook 2026 lists the taxes levied in Macao as “gaming tax, business tax, corporate income tax, personal income tax, real estate tax, tourism tax, excise duty, motor vehicle tax and asset transfer stamp duty” - the special stamp duty and the acquisition duties are gone from the list after their abolition by Law 5/2024 with effect from 20 April 2024. Do I pay anything to sell shares, funds or crypto?
Share, fund and crypto disposals attract no tax on the gain and no property-style conveyance duty: Macao stamp duty reaches “all documents and actions listed in the 'List of Taxable Items' annex of the Stamp Duty Regulations” (DSF, Stamp Duty introduction) at rates from 0.2% to 10% of the value the document represents (PwC). Any duty rides the transfer document's value, never the investor's net gain. Is there a VAT or GST in Macao?
There is no VAT or GST on a disposal or anything else: “There is no VAT regime in Macau SAR” (PwC). Consumption is taxed instead through excise duty on tobacco and alcohol entering Macao (Law 4/99/M as amended by Law 24/2024), the 5% tourism tax, motor vehicle tax and the 35% gaming tax (Macao Yearbook).
