San Marino capital gains tax calculator

San Marino taxes a private investor’s capital gains under art. 41 of Legge 166/2013 at a flat separate rate: 10% from 2026, 8% before. Shares, funds and crypto net together within the year and a net loss is lost. Real property is charged only when held five years or less, and parcels match last in, first out.

Work out the tax on a share, fund, crypto, property or precious-metals sale from your dates and costs. Enter sales by hand or import your exchange CSVs, and the calculator splits multi-parcel sales under the LIFO rule, applies the EUR 2,000 crypto exemption and the five-year property test, and shows the arithmetic behind the final figure. Everything stays in your browser.

Rates current as of 2026-09-30, from Legge 166/2013 on the Consiglio Grande e Generale site and the sources each record cites.

Questions

San Marino capital gains questions

How much is capital gains tax in San Marino?

Gains of a private investor pay a flat separate tax of 10% from tax period 2026 and 8% for 2021 through 2025. Art. 41 of Legge 166/2013 brings the gains into the charge and art. 13, as replaced by Legge 141/2025, sets the rate. The gain never enters the progressive income scale, so your salary does not change the rate.

Is there a holding period that exempts share gains?

No. A gain on shares, participations and funds is taxable whatever the holding period. Only real property has a holding test: land and buildings are charged while held for not more than five years.

Can I deduct capital losses in San Marino?

Yes, within the year. Gains and losses on shares, funds and crypto net in one basket under art. 41(6). A negative balance cannot be carried into later years. Losses on property and precious metals find no relief.

Is crypto taxed in San Marino?

Yes, from tax period 2025. Decreto Delegato 138/2024 added crypto-assets to art. 41 and exempts the first EUR 2,000 of the year's net crypto gain. A swap between crypto-assets with the same characteristics is not a taxable event. Crypto gains before 2025 are not charged.

When is property sale tax-free?

A sale after the fifth anniversary of the purchase is outside art. 41(1)(a). A sale is also exempt when the property was your main residence for most of the holding period or came to you by succession. A sale on the fifth anniversary itself is still chargeable.

Which cost method does San Marino use?

Last in, first out. Art. 41(4) treats the instruments bought most recently as sold first. Where the holdings sit with a Sammarinese intermediary authorised under the LISF, the cost is instead the weighted average of each homogeneous category.

What other taxes apply when I sell property?

Registration tax of 2.5% of the value and transcription tax of EUR 70 plus 1% of the value apply to a transfer, whether you gain or lose. A qualifying first home of up to 200 square metres pays a fixed EUR 70 registration tax. The transfer of company shares in a documented act pays registration tax of 0.75%. None of these is capital gains tax.

When do I file and pay?

The return for a calendar year is due on 31 July of the next year. A return filed within the following thirty days is valid with a sanction; after that it is null.

Does San Marino have VAT?

No. San Marino charges a single-stage import tax (imposta monofase) on imported goods and a complementary tax on services. Italian VAT applies to trade with Italy under the customs union.
